ქართული English Deutsch Français Español Italiano Polski Română Nederlands Čeština Svenska Português Русский English (USA) ქართული1.1 These rules (hereinafter referred to as the «Rules») define the terms and procedure for using the website www.Vinwiser.com (hereinafter referred to as «Vinwiser.com») and for providing services by Vinwiser.com.
1.2 By using the Vinwiser.com website in any manner — whether browsing pages, placing an order or engaging in any other interaction — the user confirms acceptance of these Rules and undertakes to comply with them. If you do not agree with at least one of the provisions, further use of Vinwiser.com is not permitted.
1.3 Vinwiser.com is owned and administered by: IE Vinwiser, reg. No. 345815086, Legal Address: Georgia, Batumi city, Zhiuli Shartava Avenue N 7, 22 (hereinafter referred to as «Vinwiser»).
2.1 Terms used in these Rules and written with a capital letter shall have the meanings specified in this section.
2.1.1. Report — a document provided to the user on Vinwiser.com containing information about the history of a vehicle.
2.1.2. Commercial User — an individual or legal entity using the services of the website for purposes related to entrepreneurial, commercial, craft or professional activities or for mixed purposes where a commercial interest prevails.
2.1.3. Credits — units credited to the user's Vinwiser.com account and used to obtain Reports. One Credit grants access to one Report.
2.1.4. User — any person using the Vinwiser.com website, including both Consumers and Commercial Users, regardless of the form of interaction or services ordered.
2.1.5. Account — a personalized user page on the Vinwiser.com website created to access certain functions and services.
2.1.6. Services — paid or free functional features available on Vinwiser.com, including ordering Reports, using Credits, and other forms of interaction.
2.1.7. VIN Decoder — an automated VIN decoding tool that allows obtaining basic vehicle information prior to purchasing a full Report.
2.1.8. Consumer — an individual using the website services exclusively for personal, non-commercial purposes or for mixed purposes where the consumer interest prevails.
2.1.9. VIN Code — a unique vehicle identification number consisting of 17 characters and assigned by the manufacturer at the time of production (Vehicle Identification Number).
2.1.10. Third-Party Websites — any web resources not owned by Vinwiser.com and not under its control.
3.1 To obtain extended access to the functionality of the Vinwiser.com website (for example, managing Credits, viewing previously ordered Reports, etc.), the user must create an Account.
3.2 An Account may be created in the following ways:
3.2.1 By entering an email address and creating a password. A confirmation email will be sent to the specified email address.
3.2.2 When placing an order for a Report or Credits — an Account is created automatically if the user provides an email address.
3.2.3 Through third-party authentication services (Google, Apple, Facebook), by granting vinwiser.com permission to access basic profile data.
3.3 The user is solely responsible for safeguarding the login and password of their Account. In case of loss of access or suspicion of unauthorized use, the user must immediately notify support at support@vinwiser.com.
3.4 The user has the right to delete their Account at any time — via profile settings or by following the link სიახლეების გამოწერის გაუქმება and completing the form.
4.1 The user may purchase Credits, which are exchanged for vehicle Reports. It is also possible to enter a VIN Code directly — in this case, a Credit will be deducted automatically, and the Report will be linked to the specific vehicle.
4.2 The cost of Credits is indicated at the time of order and may change depending on exchange rates and market conditions.
4.3 Credits are valid for 2 months from the date they are credited. After this period, they expire and become unavailable for use.
4.4 After entering the VIN Code, the user sees preliminary vehicle information decoded using the VIN Decoder. If some information is missing in the final Report compared to the sample report, this means that such information is not available in public databases, Vinwiser.com databases or partner sources.
4.5 The Report becomes available for viewing in the Account after the Credit is deducted and the Report is generated within a period ranging from 5 minutes to 24 hours. Additionally, a link to the Report is sent to the user's email address. In certain cases, searching for VIN-related information and generating the Report may take up to 24 hours depending on the operating schedules of databases in different countries. In such cases, the Report may become available within 24 hours. The Report generation status can be tracked in the personal account as "Generating report" or "Report ready".
4.6 The obtained Report may be saved in PDF format and viewed through the personal account for 30 calendar days from the date of its generation.
4.7 After the 30-day period expires, repeated access to the Report is not possible. A new order must be placed to obtain it again.
4.8 Vinwiser.com does not guarantee absolute completeness or accuracy of the provided data, as information is collected from external sources, Third-Party Websites, partner API integrations, and Vinwiser.com bears no responsibility for their content, accuracy or relevance. Depending on the country and jurisdiction, information for certain items may be displayed partially or may be entirely unavailable.
4.9 The user assumes responsibility for using the Report data and making decisions based on it (for example, purchasing or rejecting a vehicle). Vinwiser.com does not provide legal, financial or insurance advice.
4.10 The user has the right to share the obtained Report with third parties (for example, when selling a vehicle); however, resale or commercial distribution without the written consent of vinwiser.com is prohibited.
4.11 By placing an order for a Report, the user confirms having a legitimate interest in checking the specific vehicle. Vinwiser.com reserves the right to request confirmation of the purpose and to refuse to provide the Report without stating reasons.
5.1 The user undertakes to comply with the following rules when using Vinwiser.com:
5.1.1 Not to use automated systems, scripts, algorithms or any other methods (including manual ones) aimed at accessing, copying, tracking, reproducing or bypassing the structure and navigation of Vinwiser.com or obtaining information and materials not directly provided through the website interface.
5.1.2 Not to attempt unauthorized access to any sections of the website, its infrastructure, networks, servers or related systems by hacking, password guessing or other unlawful means.
5.1.3 To refrain from any actions that create excessive or disproportionate load on the technical infrastructure of Vinwiser.com.
5.1.4 Not to use technical means or software that interfere with the proper operation of the website or disrupt its functions or access for other users.
5.1.5 Not to use Vinwiser.com and its materials for illegal purposes or contrary to these Rules, nor to encourage unlawful activities or violate the rights of third parties.
5.1.6 Not to order a Report without a legitimate interest in the vehicle, and to specify only those purposes and criteria that reflect the actual intent of obtaining the Report.
5.1.7 To strictly comply with these Rules and applicable legislation when using and paying for Vinwiser.com services.
6.1 The agreement for the provision of paid services between the user and Vinwiser is deemed concluded upon successful payment, in accordance with these Rules. For Commercial Users, an individual procedure specified in a separate agreement may apply.
6.2 Payment for services on Vinwiser.com is made using bank cards, Apple Pay, Google Pay, transfers or PayPal. Services are provided to Consumers only after full payment in accordance with these Rules. A different payment procedure may apply to Commercial Users under a supplementary agreement.
6.3 Vinwiser.com may conduct marketing promotions and provide users with discount promo codes. The conditions for each promo code are determined separately, including validity period, applicable services, and other parameters.
6.4 Taking into account economic conditions in different markets, Vinwiser.com reserves the right to set different prices for services in different countries.
6.5 Vinwiser.com services are considered to be provided electronically. For private users, tax jurisdiction is determined in accordance with the laws of the relevant country. Vinwiser.com uses technical and other available means to determine the user's country of residence. In case of discrepancies, information provided by the user shall also be taken into account, and the user bears responsibility for its accuracy. For Commercial Users, the general procedure for determining tax location applies in accordance with the above-mentioned law.
7.1 The Consumer has the right to withdraw from the service agreement (for example, the purchase of Credits) within 14 calendar days without stating reasons. To do so, the Consumer sends a notification to support@vinwiser.com indicating the order number and date, contact details, and intention to withdraw. Vinwiser refunds all received payments no later than 14 days from the date of receipt of the withdrawal notice, except for cases specified in clause 7.2.
7.2 If the Consumer exchanges Credits for a Report, the Consumer acknowledges and agrees that the Report constitutes digital content. In such case, the Consumer loses the right to a 14-day refund. If the Consumer purchases a Credit package and uses at least one Credit from the package, the right to a refund is forfeited for the entire package, taking into account the specifics of bundled discounts and conditions.
8.1 Detailed information on the processing of personal data is available at კონფიდენციალურობის პოლიტიკა and Cookie პოლიტიკა. By using Vinwiser.com services and confirming acceptance of these Rules, the user also confirms that they have reviewed the Privacy Policy.
8.2 For legal entities and Commercial Users: Vinwiser and the Commercial User act as independent data controllers. Each party undertakes to comply with applicable data protection laws when processing information related to the performance of these Rules.
9.1 Vinwiser reserves the right to unilaterally amend these Rules, the list of services or their prices. In the event of a material deterioration of conditions for Consumers, we will notify them via the email specified in the Account in advance, but no later than 5 calendar days. Continued use of the service after notification constitutes acceptance of the changes.
9.2 Vinwiser has the right to restrict or terminate user access to the service in case of violation of these Rules or applicable law. If an Account exists, the user will be notified by email. Reuse of the service after suspension without authorization is prohibited.
9.3 Vinwiser may temporarily suspend the service for scheduled maintenance; we will endeavor to notify users in advance. In emergency situations, maintenance may be carried out without prior notice, while measures will be taken to avoid affecting users’ rights under already initiated and ongoing services.
9.4 Vinwiser bears no responsibility for service unavailability caused by force majeure circumstances. In such cases, we will promptly inform users of the situation and measures being taken.
10.1 The user undertakes to indemnify, defend, and hold harmless Vinwiser, as well as its affiliates, representatives, and employees, from any claims, losses, expenses, and damages arising from: 1. violation of these Rules by the user; 2. violation of applicable law by the user; 3. decisions made by the user based on information from the Report.
10.2 To the maximum extent permitted by law, Vinwiser shall not be liable for indirect damages, including financial losses, loss of profit or other consequences arising from the use of the service.
10.3 Vinwiser provides technical hosting and delivery of Reports but does not guarantee the completeness, accuracy or timeliness of data obtained from external sources. The user acknowledges that Reports are generated based on third-party data and bears responsibility for verifying information when making critical decisions.
10.4 The website may contain links to third-party resources. These links are provided for convenience and do not imply endorsement of the content of such websites. Vinwiser does not control and is not responsible for the content, privacy policies or actions of the owners of such resources.
10.5 Vinwiser.com shall not be liable for any losses, including financial losses, arising from delays in Report delivery caused by lack of access to third-party databases or servers.
10.6 The user agrees that Report generation after payment and Credit deduction may take up to 24 hours depending on the availability of external databases and servers. During this period, the service is considered provided, and refunds of funds or Credits (including via chargeback) are not possible until Report generation is completed. Vinwiser.com undertakes to inform the user of the Report generation status via the personal account and by sending an email notification.
11.1 All elements placed on Vinwiser.com — including but not limited to content, software code, design, domain name, texts, images, databases, trademarks, and logos — are the property of Vinwiser or are used lawfully (for example, under license or agreement). Exceptions apply to elements belonging to partners and suppliers, whose rights are also protected by applicable national and international intellectual property laws.
11.2 The user is prohibited from reproducing, copying, distributing, publishing, adapting, editing, modifying, transferring, displaying, selling, licensing or otherwise using the content of Vinwiser.com (including its software code) without prior written consent of the rights holder. The creation of derivative works based on such content is also prohibited.
12.1 Vinwiser.com operates in accordance with the legislation applicable to the interpretation and implementation of these Rules. All disputes related to the use of the website and provided Services shall be resolved within the legal framework of the applicable state.
12.2 If a dispute arises between Vinwiser and a Commercial User, it shall be resolved in the court at the place of registration of Vinwiser.
12.3 A Consumer who believes that their rights have been violated in connection with the provision of services must first submit a written complaint to support@vinwiser.com. In the event of an unsatisfactory response, the Consumer may contact the relevant public authority or use alternative dispute resolution platforms.
13.1 Vinwiser reminds users that they are solely responsible for safeguarding their Account login credentials. It is recommended to use unique passwords and exercise caution, especially when accessing the service from public or shared devices. Users are advised to log out of their Account upon completing their session.
13.2 Although Vinwiser makes reasonable efforts to protect users’ personal data, it should be noted that data transmission over the Internet involves certain risks. Vinwiser cannot guarantee absolute security of transmitted data and shall not be liable for potential data breaches caused by third parties.
14.1 These Rules constitute the complete and final agreement between the user and Vinwiser and supersede all prior agreements, whether oral or written, relating to the subject matter hereof. In certain cases, Vinwiser may enter into an individual agreement with the user containing terms that differ from those set forth herein.
14.2 If any provision of these Rules is found by a court to be invalid or unenforceable, this shall not affect the validity of the remaining provisions, which shall remain in full force and effect to the maximum extent permitted by law.
14.3 Vinwiser has the right to assign its rights and obligations under these Rules to third parties without the user's separate consent, provided that this does not affect consumer guarantees. The user may not assign their rights or obligations without the prior written consent of Vinwiser.
14.4 Failure by either party to exercise any right provided under these Rules shall not be deemed a waiver of such right in the future.
